Washington Consumer Health Data Privacy Policy for SheHerMe
Effective date:
This policy supplements the SheHerMe Privacy Notice and applies to personal data that qualifies as consumer health data under the Washington My Health My Data Act (MHMDA) and is processed in connection with SheHerMe by Lovehoney Group US Trading Limited.
1. Consumer health data we collect and how we use it
Depending on the SheHerMe features you use, we collect the following categories of consumer health data:
- Symptoms, menstruation or cycle information, and other health, wellbeing, reproductive or sexual-health information you provide in wellbeing functions or journal entries. We use this information to provide the functions you request and to store and display your entries and history.
- Information about your use of a compatible connected device, to the extent that the information relates to or reveals health, wellbeing, reproductive health or sexual health. We use this information to provide the connected-device functions you request.
- Health, wellbeing, reproductive or sexual-health information that you choose to include when contacting customer support. We use this information to respond to and handle your request.
We may also use consumer health data as necessary to protect the security and integrity of the App and accounts and to comply with applicable legal obligations.
2. Sources of consumer health data
We collect consumer health data directly from you and from compatible devices that you choose to connect to SheHerMe.
3. Consumer health data we share; third parties and affiliates
We do not currently share consumer health data with third parties or affiliates as “sharing” is defined under MHMDA. Accordingly, there are currently no categories of consumer health data shared and no third parties or specific affiliates with whom we share consumer health data under MHMDA.
Service providers acting as processors may process consumer health data on our behalf where necessary to provide the SheHerMe services you request. MHMDA does not treat a disclosure to a processor as “sharing” when the disclosure is consistent with the purpose for which the consumer health data was collected and disclosed to you.
4. Your Washington consumer health data rights
Under MHMDA, you may have the right to:
- confirm whether we collect, share or sell consumer health data about you and access that data, including information about third parties and affiliates with whom it has been shared or sold;
- withdraw consent to our collection or sharing of your consumer health data; and
- request deletion of your consumer health data.
You can exercise these rights by contacting privacy@lovehoneygroup.com or through the Lovehoney Group Privacy Center at https://privacy-center.lovehoneygroup.com/. We may take reasonable steps to authenticate your request. You do not need to create a new account to exercise these rights.
If we refuse to act on your request, you may appeal by contacting legal@lovehoneygroup.com. If an appeal is denied, we will provide a method for you to contact the Washington Attorney General to submit a complaint.
